Artikel 1

Article 1

Jedes Kind hat Anspruch auf den Schutz und die Fürsorge, die für sein Wohlergehen notwendig sind, auf bestmögliche Entwicklung und Entfaltung sowie auf die Wahrung seiner Interessen auch unter dem Gesichtspunkt der Generationengerechtigkeit. Bei allen Kinder betreffenden Maßnahmen öffentlicher und privater Einrichtungen muss das Wohl des Kindes eine vorrangige Erwägung sein.

Each child shall be entitled to the protection and care that is necessary for his/her well-being, to optimal development and self-realisation as well as to the protection of his/her interests with regards to intergenerational equity. The well-being of the child shall be the primary consideration in respect of all measures affecting children that are taken by public and private institutions.

Artikel 2

Article 2

  1. Absatz einsJedes Kind hat Anspruch auf regelmäßige persönliche Beziehungen und direkte Kontakte zu beiden Elternteilen, es sei denn, dies steht seinem Wohl entgegen.
  1. Absatz einsEach child shall be entitled to have personal relations and direct contacts with both parents on a regular basis unless this is detrimental to the well-being of the child.
  1. Absatz 2Jedes Kind, das dauernd oder vorübergehend aus seinem familiären Umfeld, welches die natürliche Umgebung für das Wachsen und Gedeihen aller ihrer Mitglieder, insbesondere der Kinder ist, herausgelöst ist, hat Anspruch auf besonderen Schutz und Beistand des Staates.
  1. Absatz 2Each child that is removed permanently or temporarily from his/her family surroundings, which are the natural environment for the growth and development of all family members, in particular children, shall be entitled to the special protection and support of the state.

Article 3

Kinderarbeit ist verboten. Abgesehen von gesetzlich vorgesehenen begrenzten Ausnahmen darf das Mindestalter für den Eintritt in das Arbeitsleben das Alter, in dem die Schulpflicht endet, nicht unterschreiten.

Child labour is prohibited. Apart from any exemptions laid down by law, the minimum age for entering the labour market shall not be below the age at which compulsory schooling ends.

Artikel 4

Article 4

Jedes Kind hat das Recht auf angemessene Beteiligung und Berücksichtigung seiner Meinung in allen das Kind betreffenden Angelegenheiten, in einer seinem Alter und seiner Entwicklung entsprechenden Weise.

Each child has the right to adequate involvement and consideration of his/her opinion regarding all matters affecting the child in a manner that is commensurate with his/her age and development.

Artikel 5

Article 5

  1. Absatz einsJedes Kind hat das Recht auf gewaltfreie Erziehung. Körperliche Bestrafungen, die Zufügung seelischen Leides, sexueller Missbrauch und andere Misshandlungen sind verboten. Jedes Kind hat das Recht auf Schutz vor wirtschaftlicher und sexueller Ausbeutung.
  1. Absatz einsEach child has the right to non-violent education. Physical punishment, the infliction of mental pain, sexual abuse and any other maltreatment is forbidden. Each child has the right to protection against commercial and sexual exploitation.
  1. Absatz 2Jedes Kind als Opfer von Gewalt oder Ausbeutung hat ein Recht auf angemessene Entschädigung und Rehabilitation. Das Nähere bestimmen die Gesetze.
  1. Absatz 2Each child who is the victim of violence or exploitation has a right to adequate compensation and rehabilitation. Further details are laid down in the applicable laws.

Artikel 6

Article 6

Jedes Kind mit Behinderung hat Anspruch auf den Schutz und die Fürsorge, die seinen besonderen Bedürfnissen Rechnung tragen. Im Sinne des Artikel 7 Absatz eins, B-VG ist die Gleichbehandlung von behinderten und nicht behinderten Kindern in allen Bereichen des täglichen Lebens zu gewährleisten.

Each child with a disability shall be entitled to the level of protection and care that is required for his/her special needs. In accordance with Article 7, para. 1 of the Federal Constitution Act, the equal treatment of children with and without disabilities shall be guaranteed in all spheres of daily life.

Article 7

Eine Beschränkung der in den Artikeln 1, 2, 4 und 6 dieses Bundesverfassungsgesetzes gewährleisteten Rechte und Ansprüche ist nur zulässig, insoweit sie gesetzlich vorgesehen ist und eine Maßnahme darstellt, die in einer demokratischen Gesellschaft für die nationale Sicherheit, die öffentliche Ruhe und Ordnung, das wirtschaftliche Wohl des Landes, die Verteidigung der Ordnung und zur Verhinderung von strafbaren Handlungen, zum Schutz der Gesundheit oder zum Schutz der Rechte und Freiheiten anderer notwendig ist.

Any limitation of the rights and entitlements guaranteed in Articles 1, 2, 4 and 6 of this Federal Constitutional Act shall not be permissible unless this is provided for in the law and constitutes a measure that is necessary in a democratic society to uphold national security and safety, public peace and order, the economic well-being of the country, to defend public order and to prevent criminal offences, to protect health or to protect the rights and freedoms of others.

Artikel 8

Article 8

Mit der Vollziehung dieses Bundesverfassungsgesetzes ist die Bundesregierung betraut.

The federal government shall be responsible for implementing this Federal Constitutional Act.
