Der Nationalrat besteht aus 183 Mitgliedern, die nach den Bestimmungen dieses Bundesgesetzes gewählt werden.

Die Wahl ist von der Bundesregierung durch Verordnung im Bundesgesetzblatt auszuschreiben. Die Verordnung hat den Wahltag zu enthalten, der von der Bundesregierung im Einvernehmen mit dem Hauptausschuss des Nationalrates auf einen Sonntag oder einen gesetzlichen Feiertag festzusetzen ist. Die Verordnung hat weiters den Stichtag zu enthalten. Der Stichtag darf nicht vor dem Tag der Ausschreibung der Wahl und muss am zweiundachtzigsten Tag vor dem Wahltag liegen. Nach dem Stichtag bestimmen sich die in den §§ 13, 14, 16 und 25 dieses Bundesgesetzes festgesetzten Fristen sowie die Voraussetzungen des Wahlrechts (§ 21 Abs. 1) und der Wählbarkeit (§ 41).

Elections are to be announced in the Federal Law Gazette on decree of the federal government. The decree must contain the election day which has to be scheduled on a Sunday or a public holiday by the federal government in agreement with the main committee of the National Council. The decree must also contain the qualifying date. The qualifying date must not be before the day of the announcement of the elections and must be on the eighty-second day before the election day. The deadlines fixed in § 13, § 14, § 16 and § 25 of this federal law as well as the prerequisites for an eligibility to vote (§ 21, para 1) and to be elected (§ 41) are to be set in accordance with the qualifying date.

Die Verordnung der Bundesregierung über die Wahlausschreibung ist auch in allen Gemeinden durch öffentlichen Anschlag bekanntzumachen.

The decree of the federal government on the announcement of the elections has to also be announced in all municipalities by a public notice.

Das Bundesgebiet wird für Zwecke der Wahl in neun Landeswahlkreise eingeteilt; hierbei bildet jedes Bundesland einen Landeswahlkreis. Der Landeswahlkreis führt die Bezeichnung des Bundeslandes und erhält eine Nummer, die sich nach der alphabetischen Reihenfolge der Bundesländer richtet.

The federal territory is divided in nine provincial constituencies for the purposes of the elections; in this case every province constitutes a provincial constituency. The provincial constituency carries the name of the respective province and receives a number, corresponding to the alphabetical order of all provinces.

Irrespective of the provisions on casting a vote by means of a voting card, the casting of votes takes place in the presence of the local elections authority. In accordance with this federal law, the local elections authority can be a municipal elections authority or a ward elections authority.

Fundamentally every political district, in the provinces of Lower Austria and Vorarlberg every administrative district, as well as every town with its own charter constitutes an electoral district. In the City of Vienna every municipal district is also an electoral district.

The electoral districts of the provincial constituencies are united in one or more regional constituencies. The regional constituencies carry the number of their respective provincial constituency and are additionally marked by a letter in alphabetical order.

The electoral districts of the regional constituencies are listed in schedule 1 of this document.

The number of seats in the National Council in every constituency is to be calculated in accordance with the regulations set out in paras 2 to 5.

Die Zahl der Staatsbürger, die nach dem endgültigen Ergebnis der jeweils letzten Volkszählung (Registerzählungsgesetz, BGBl. I Nr. 33/2006) im Gebiet der Republik ihren Hauptwohnsitz hatten, vermehrt um die Zahl der im Ausland lebenden Staatsbürger, die am Stichtag (§ 1 Abs. 1 des Registerzählungsgesetzes) in der Wählerevidenz eingetragen waren, ist durch die Zahl 183 zu teilen. Dieser Quotient ist auf drei Dezimalstellen zu berechnen. Er bildet die Verhältniszahl.

The number of citizens who, according to the final results of the last census (Register Census Act, Federal Law Gazette I No. 33/2006), had their main place of residence in the Republic of Austria, added to the number of citizens living abroad, who, on the cut-off date (§ 1, para 1 of the Register Census Act) were entered in the voters’ index, has to be divided by 183. The result has to be rounded to three decimal places. This gives the proportion figure.

Jedem Landeswahlkreis werden so viele Mandate zugewiesen, wie die Verhältniszahl (Abs. 2) in der Zahl der Staatsbürger, die nach dem endgültigen Ergebnis der jeweils letzten Volkszählung im Landeswahlkreis ihren Hauptwohnsitz hatten, vermehrt um die Zahl der im Ausland lebenden Staatsbürger, die am Stichtag (§ 1 Abs. 1 des Registerzählungsgesetzes) in der Wählerevidenz im Bereich des Landeswahlkreises eingetragen waren, enthalten ist.

Every provincial constituency receives the number of seats which results from the division by the proportion figure of the number of citizens (para 2) which, according to the final results of the last census, had their main place of residence in the respective provincial constituency, added to the number of those living abroad who, on the cut-off date (§ 1, para 1 of the Register Census Act), were entered into the voters’ index of the same provincial constituency.

Können auf diese Weise noch nicht alle 183 Mandate aufgeteilt werden, so sind die gemäß Abs. 3 zu ermittelnden Quotienten auf je drei Dezimalstellen zu berechnen. Die restlichen Mandate erhalten zusätzlich die Landeswahlkreise, bei denen sich der Reihenfolge nach die größten Dezimalreste ergeben. Sind hierbei die Dezimalreste bei zwei oder mehreren Landeswahlkreisen gleich groß, so erhalten diese Landeswahlkreise je ein restliches Mandat, es sei denn, daß es sich um die Zuweisung des letzten der 183 Mandate handelt. Hätten auf die Zuweisung dieses letzten Mandates infolge gleich hoher Dezimalreste zwei oder mehrere Landeswahlkreise den gleichen Anspruch, so entscheidet über die Frage, welchem Landeswahlkreis dieses letzte restliche Mandat zufällt, das Los.

In case that, in following the described procedure, it is not possible to distribute all 183 seats, the results of the calculations described in para 3 have to be rounded up to the third digit after the decimal sign. The remaining seats are then allocated to those provincial constituencies, which have the largest decimal figure. When, however, the decimal figures of more than one provincial constituency are equal, they each receive an additional seat, except when there is only one seat, from the 183, left to be allocated. When, as a result of an equal decimal figure, more than one provincial constituency is in a position to receive the remaining seat, the question of which one does receive it is decided by drawing lots.

Every regional constituency receives the number of National Council seats, taken from the total number of seats allocated to the respective provincial constituency, calculated in the way described in paras 3 and 4.

Die so kundgemachte Verteilung der Mandate ist allen Wahlen des Nationalrates zugrunde zu legen, die vom Wirksamkeitsbeginn der Kundmachung an bis zur Verlautbarung der Kundmachung der Mandatsverteilung auf Grund der jeweils nächsten Volkszählung stattfinden.

The announced distribution of seats has to be at the basis of all parliament National Council elections which take place after the coming into force of the announced seat distribution and before the announcement of the new one, following the next census.

For a change of area to become effective, the number of seats (para 1) has to be republished. With this announcement, the last announced seat distribution becomes invalid.

Zur Leitung und Durchführung der Wahl sind Wahlbehörden berufen. Sie werden vor jeder Wahl neu gebildet.

Elections authorities are appointed for the administration and carrying out of the elections. They are selected again for each new election.

Die Wahlbehörden bestehen aus einem Vorsitzenden als Wahlleiter oder seinem Stellvertreter sowie einer Anzahl von Beisitzern. Für jeden Beisitzer ist für den Fall seiner Verhinderung auch ein Ersatzbeisitzer zu berufen.

The elections authorities consist of a chairman who functions as a returning officer or as his deputy and a number of assistants. For every assistant there has to be appointed a substitute in case of prevention.

Mitglieder der Wahlbehörden können nur Personen sein, die das Wahlrecht zum Nationalrat besitzen. Personen, die diesem Erfordernis nicht entsprechen, scheiden aus der Wahlbehörde aus. Die nicht den Vorsitz führenden Stellvertreter sowie die Ersatzbeisitzer, die bei der Beschlußfähigkeit und bei der Abstimmung nicht berücksichtigt werden, sind den Mitgliedern der Wahlbehörden im übrigen gleichzuhalten.

Only people who have the right to vote in the National Council election can be appointed to the elections authorities. Those who do not fulfil this requirement are excluded from the elections authorities. The representatives who are not in the position of a chairperson as well as the substitutes who are not directly involved in the vote or in the constitution of a quorum are put on an equal footing with the remaining members of the elections authorities.

Das Amt des Mitgliedes einer Wahlbehörde ist ein öffentliches Ehrenamt, zu dessen Annahme jeder Wahlberechtigte verpflichtet ist, der in der Gemeinde, in der die betreffende Wahlbehörde ihren Sitz hat, seinen Hauptwohnsitz hat.

The post of a member of the elections authorities is a public honorary post. Every person entitled to vote who has its main place of residence in the municipality where the respective elections authorities have their headquarters is obliged to accept the offer of this post.

Das Ausüben mehrerer Funktionen durch eine Person in ein und derselben Wahlbehörde ist unzulässig.

A person is not permitted to exercise several functions in one and the same elections authority.

Die Wahlleiter, ihre Stellvertreter, die Beisitzer, die Ersatzbeisitzer, die Vertrauenspersonen gemäß § 15 Abs. 4 sowie die Hilfskräfte gemäß § 7 Abs. 2 sind verpflichtet, alle ihnen ausschließlich in Ausübung ihrer Tätigkeit bekannt gewordenen Informationen geheim zu halten, soweit und solange dies aus den in Art. 22a Abs. 2 B-VG genannten Gründen erforderlich und verhältnismäßig ist.

Die Durchführung und Leitung der Wahlen obliegt den Wahlbehörden. Die Wahlleiter haben die Geschäfte zu besorgen, die ihnen nach diesem Bundesgesetz zukommen. Sie haben auch die Sitzungen der Wahlbehörden vorzubereiten sowie die Beschlüsse der Wahlbehörden durchzuführen.

The elections authorities are responsible for carrying out and administration of the elections. The returning officers are to execute the duties which they are responsible for according to this federal law. They are also to prepare the meetings of the elections authorities as well as to execute their resolutions.

Den Wahlbehörden werden die notwendigen Hilfskräfte und Hilfsmittel von dem Amt zugewiesen, dem der Wahlleiter vorsteht oder von dessen Vorstand er bestellt wird. Die damit verbundenen Kosten sind von der Gebietskörperschaft zu tragen, die für den Aufwand des betreffenden Amtes aufzukommen hat.

The elections authorities receive the necessary assistance and aid from the office whose chairman or member of the committee is the present returning officer. The resulting expenses are beard by the respective authorities responsible for meeting the costs of the concerned office.

Für jede Gemeinde, ausgenommen in Statutarstädten, wird eine Gemeindewahlbehörde eingesetzt. In Statutarstädten, in Wien insoweit nicht der Magistrat zuständig ist, tritt die Bezirkswahlbehörde an die Stelle der Gemeindewahlbehörde.

For every municipality, with the exception of towns with their own charter, a municipal elections authority is established. In towns with their own charter, and in Vienna unless the Vienna City Administration has jurisdiction, the district elections authority replaces the municipal elections authority.

Der Bürgermeister hat für den Fall der vorübergehenden Verhinderung des Gemeindewahlleiters auch einen oder zwei Stellvertreter zu bestellen und im Fall der Bestellung von zwei Stellvertretern die Reihenfolge zu bestimmen, in der diese zu seiner Vertretung berufen sind.

In case the municipal returning officer should be temporarily prevented from carrying out his/her duties, the mayor has to appoint one or two deputies, and if two deputies have been appointed, determine the order in which they are to represent the municipal returning officer.

Ein auf Grund landesgesetzlicher Bestimmungen an Stelle eines Bürgermeisters vorübergehend eingesetzter Organwalter (z. B. Regierungskommissär, Amtsverwalter) hat die einem Bürgermeister auf Grund dieses Bundesgesetzes zukommenden Rechtshandlungen wahrzunehmen.

An official representative (e.g. government commissioner, administrative manager) temporarily appointed on the basis of provincial legislation to replace a mayor has to perform the legal acts which a mayor is responsible for according to this federal law.

In Gemeinden, die in Wahlsprengel eingeteilt sind, ist für jeden Wahlsprengel eine Sprengelwahlbehörde einzusetzen. In den Landeswahlkreisen außerhalb von Wien kann in einem der Wahlsprengel auch die Gemeindewahlbehörde die Geschäfte der Sprengelwahlbehörde versehen.

In municipalities divided into wards, there has to be a separate ward elections authority for each ward. In the provincial constituencies outside of Vienna, the duties of the ward elections authority in one of the wards can be taken over by the municipal elections authority.

Die Sprengelwahlbehörde besteht aus dem vom Bürgermeister zu bestellenden Vorsitzenden als Sprengelwahlleiter und drei Beisitzern.

The ward elections authority consists of a chairperson in the capacity of a ward returning officer appointed by the mayor and three assistants.

Der Bürgermeister hat für den Fall der vorübergehenden Verhinderung des Sprengelwahlleiters auch einen oder zwei Stellvertreter zu bestellen und im Fall der Bestellung von zwei Stellvertretern die Reihenfolge zu bestimmen, in der diese zu seiner Vertretung berufen sind.

In case the ward returning officer should be temporarily prevented from carrying out his/her duties, the mayor has to appoint one or two deputies, and if two deputies have been appointed, determine the order in which they are to represent the ward returning officer.

Für jeden politischen Bezirk (Verwaltungsbezirk), jede Stadt mit eigenem Statut und in der Stadt Wien am Sitz eines jeden Magistratischen Bezirksamtes wird eine Bezirkswahlbehörde eingesetzt. Die örtliche Zuständigkeit der Bezirkswahlbehörden in Wien richtet sich nach dem Zuständigkeitsbereich des Magistratischen Bezirksamtes.

For every political district (administrative district), every town with its own charter and in the City of Vienna in the location of the respective district office of the Vienna City Administration, there has to be appointed a district elections authority. The local jurisdiction of the district elections authorities in the City of Vienna corresponds to the jurisdiction of the respective district office of the Vienna City Administration.

Die Bezirkswahlbehörde besteht aus dem Bezirkshauptmann, in Städten mit eigenem Statut aus dem Bürgermeister, in der Stadt Wien aus dem Leiter des Magistratischen Bezirksamtes oder einem von ihm zu bestellenden ständigen Vertreter als Vorsitzendem und Bezirkswahlleiter sowie aus neun Beisitzern.

The district elections authority consists of the leader of the district, in the case of towns with their own charter the mayor and in the City of Vienna the head of the district office of the Vienna City Administration or a permanent replacement appointed by them in the capacity of a chairperson and district returning officer and nine assistants.

Der Bezirkswahlleiter hat für den Fall seiner vorübergehenden Verhinderung mehrere Stellvertreter zu bestellen und die Reihenfolge zu bestimmen, in der diese zu seiner Vertretung berufen sind.

In case the district returning officer should be temporarily prevented from carrying out his or her duties, he or she has to appoint several deputies and determine the order in which they are to represent him or her.

Die Bezirkswahlbehörde hat ihren Sitz am Amtsort des Bezirkswahlleiters.

The district elections authority has its headquarter in the location of the office of the respective district returning officer.

Die Mitglieder der Bezirkswahlbehörden dürfen außerhalb Wiens nicht gleichzeitig Mitglieder von Gemeindewahlbehörden, in Wien nicht gleichzeitig Mitglieder der Landeswahlbehörde für den Landeswahlkreis Wien sein.

Outside of the City of Vienna, the members of the district elections authorities cannot, at the same time, be members of the municipal elections authorities. In the City of Vienna, the members of the district elections authorities cannot, at the same time, be members of the provincial elections authority for the constituency of the City of Vienna.

Für jedes Bundesland wird am Sitz des Amtes der Landesregierung eine Landeswahlbehörde eingesetzt.

For every province a provincial elections authority has to be appointed, which are to be based in the office of the provincial government.

Sie besteht aus dem Landeshauptmann oder einem von ihm zu bestellenden ständigen Vertreter als Vorsitzendem und Landeswahlleiter sowie aus neun Beisitzern.

These consist of the provincial governor or a permanent replacement appointed by them in the capacity of a chairperson and provincial returning officer and nine assistants.

Der Landeshauptmann hat für den Fall seiner vorübergehenden Verhinderung mehrere Stellvertreter zu bestellen und die Reihenfolge zu bestimmen, in der diese zu seiner Vertretung berufen sind.

In case the provincial governor should be temporarily prevented from carrying out his or her duties, he or she has to appoint several deputies and determine the order in which they are to represent him or her.

Für das ganze Bundesgebiet wird am Sitz des Bundesministeriums für Inneres die Bundeswahlbehörde eingesetzt.

For the whole federal territory there has to be appointed the Federal Ministry of Internal Affairs

Sie besteht aus dem Bundesminister für Inneres als Vorsitzendem und Bundeswahlleiter und siebzehn Beisitzern, darunter zwei Richter des Dienst- oder Ruhestandes.

Die Mitglieder der Bundeswahlbehörde dürfen keiner anderen Wahlbehörde angehören.

The members of the federal elections authority cannot be members of other elections authorities.

Der Bundesminister für Inneres hat für den Fall seiner vorübergehenden Verhinderung mehrere Stellvertreter zu bestellen und die Reihenfolge zu bestimmen, in der diese zu seiner Vertretung berufen sind.

In case the Federal Minister of Internal Affairs should be temporarily prevented from carrying out his or her duties, he or she is to appoint several representatives as well as to determine the order in which they are to represent him or her.

Die Bundeswahlbehörde führt, unbeschadet des ihr nach § 7 Abs. 1 zukommenden Wirkungskreises, die Oberaufsicht über alle anderen Wahlbehörden. Im Rahmen dieses Aufsichtsrechts kann die Bundeswahlbehörde insbesondere rechtswidrige Entscheidungen und Verfügungen der nachgeordneten Wahlbehörden aufheben oder abändern. Entscheidungen der Wahlbehörden im Berichtigungs- und Beschwerdeverfahren gegen die Wählerverzeichnisse (Stimmlisten) können von der Bundeswahlbehörde nicht abgeändert werden.

The federal elections authority supervises, irrespective of the constituency allocated to them according to the regulations set out in § 7, para 1, the work of all other elections authorities. As a result of this, the federal elections authority has the right to disregard or modify any decision or decree, especially the illegal ones, made by subordinate elections authorities. Decisions of any elections authorities in proceedings regarding corrections or complaints against the electoral rolls (voters’ lists) cannot be changed by the federal elections authority.

Die Bundeswahlbehörde kann auch eine Überschreitung der in den §§ 13, 14, 16, 39, 47, 61, 106, 109, 111, 112 und 124 Abs. 3 festgesetzten Termine für zulässig erklären, falls deren Einhaltung infolge von Störungen des Verkehrs oder aus sonstigen unabweislichen Gründen nicht möglich ist. Durch eine solche Verfügung dürfen jedoch die in anderen Bestimmungen dieses Bundesgesetzes vorgesehenen Termine und Fristen nicht beeinträchtigt werden.

The federal elections authority has also the right to tolerate a delay in the deadlines set out in § 13, § 14, § 16, § 39, § 47, § 61, § 106, § 109, § 111, § 112 and § 124, para 3, when it is caused by disturbances in the traffic or any other unavoidable circumstances. It is however not possible to tolerate delays in any other deadlines set out in the remaining paragraphs of this federal law.

Die Sprengelwahlleiter, die nach den §§ 8, 10 und 11 zu bestellenden ständigen Vertreter sowie alle für den Fall einer vorübergehenden Verhinderung zu berufenden Stellvertreter der Wahlleiter der vor jeder Wahl neu zu bildenden Wahlbehörden sind spätestens am siebenten Tag nach dem Stichtag zu ernennen, es sei denn, daß es sich um die Ernennung dieser Organe bei Wahlbehörden handelt, deren Bildung aus einem der im § 14 Abs. 4 angeführten Gründe erst nachträglich unabweislich geworden ist.

The returning officer, the permanent representative appointed according to the regulations set out in § 8, § 10 and § 11, as well as any other substitutes, who could be called on in case the returning officer should be prevented from carrying out his/her duties, are part of an election authority, which has to be re-elected for each new election. These have to be nominated seven days after the qualifying date, at the latest, except when such nominations are carried out for elections authorities, the setting up of which is being delayed for any of the reasons discussed in § 14, para 4.

Vor Antritt ihres Amtes haben die bestellten Organe ihre strenge Unparteilichkeit und gewissenhafte Erfüllung ihrer Pflichten gegenüber demjenigen, der ihre Bestellung vorgenommen hat, oder einem von diesem Beauftragten durch die Worte „ich gelobe“ oder durch ein Zeichen der Zustimmung zu geloben.

Before taking their position, the elected officials have to give a vow as to their impartiality and conscientious fulfilment of their duties to the person who appointed them or to someone commissioned by that person by saying the words "I swear" or by giving a sign of consent.

Bis zur Konstituierung der vor jeder Wahl neu zu bildenden Wahlbehörden haben deren Vorsitzende (Stellvertreter) alle unaufschiebbaren Geschäfte, die diesen Wahlbehörden obliegen, zu besorgen und insbesondere auch Eingaben entgegenzunehmen.

Until the composition of the new elections authorities before every election, their chairmen (or representatives) are to conduct all urgent affairs of these authorities as well as to take in all applications.

Spätestens am zehnten Tag nach dem Stichtag haben die Vertrauensleute der Parteien, die sich an der Wahlbewerbung (§ 42) beteiligen wollen, ihre Vorschläge über die gemäß § 15 Abs. 3 zu bestellenden, nicht dem richterlichen Beruf entstammenden Beisitzer und Ersatzbeisitzer der neu zu bildenden Wahlbehörden bei den im Abs. 3 bezeichneten Wahlleitern dieser Wahlbehörden einzubringen. Den Vorschlägen ist, unbeschadet der Bestimmungen des § 15 Abs. 2, die Anzahl der Beisitzer und Ersatzbeisitzer zugrunde zu legen, die ihnen nach der Zusammensetzung der Wahlbehörden am Stichtag zukommt.

On the tenth day after the qualifying date at the latest, the persons of confidence of the parties wanting to take part in the election campaign (§ 42) have to present to the returning officer of the respective elections authorities, as defined in para 3, their proposals for the appointment of the assistant and their substitute, who should not be judges by profession, as set out in § 15, para 3. These proposals have to be based on the number of assistants and their substitutes, who are due to each party, after the composition of the elections authorities on the qualifying date, irrespective of the regulations set out in § 15, para 2.

Die Eingaben sind für die Bildung der Bundeswahlbehörde an den Bundesminister für Inneres als Bundeswahlleiter, für die Bildung der Landeswahlbehörden an den Landeshauptmann, für die Bildung der Bezirkswahlbehörden an den Landeswahlleiter und für die Bildung der Gemeinde- und Sprengelwahlbehörden an den Bezirkswahlleiter zu richten.

The applications for the composition of the federal elections authority are to be addressed to the Federal Minister of Internal Affairs acting in the capacity of a federal returning officer. The applications for the composition of the provincial elections authorities are to be addressed to the leader of the respective province; for the composition of the district elections authorities - to the provincial returning officer and for the composition of the municipal and ward elections authorities they are to be addressed to the district returning officer.

Verspätet einlangende Eingaben sind nicht zu berücksichtigen, es sei denn, daß es sich um Wahlbehörden handelt, deren nachträgliche Bildung durch Änderungen in den Wahlsprengeln, in den Gemeindegebieten oder in den politischen Bezirken unabweislich geworden ist.

Delayed applications cannot be considered, except they are elections authorities, whose delayed composition is made necessary by changes in the wards, in the municipal areas or in the political districts.

Der Wahlleiter kann verlangen, daß die Vertrauensleute einer Partei, die Vorschläge gemäß Abs. 1 einbringt, ausdrücklich und schriftlich erklären, daß sich diese Partei an der Wahlbewerbung gemäß § 42 beteiligen wolle. Wird diese Erklärung nicht abgegeben, so gelten die Vorschläge als nicht eingebracht. Sind dem Wahlleiter die Vertrauensleute bekannt und ist er in der Lage, zu beurteilen, ob die einreichenden Personen tatsächlich die Partei vertreten, oder wird ein Antrag von einer im Nationalrat vertretenen Partei eingebracht, so hat er den Antrag sofort in weitere Behandlung zu nehmen. Ist dies nicht der Fall, so hat er die Antragsteller zu veranlassen, daß die Eingabe, sofern dies nicht bereits geschehen ist, noch innerhalb der im Abs. 1 bestimmten Frist von wenigstens hundert Wahlberechtigten unterschrieben wird.

The returning officer has the right to demand from the persons of confidence of a party which produces applications according to para 1 to declare explicitly and in writing that the respective party wants to take part in the election campaign, according to § 42. When such a declaration is not presented, the applications are not taken into consideration. When the persons of confidence of a party are known to the returning officer and he or she is in a position to decide whether they are indeed representatives of the respective party, or when an application is made by one of the parties, represented in the National Council, the returning officer has to accept the application for further processing immediately. When this is not the case the applicant has to see to it, if this has not yet been done, that the application is signed by at least 100 persons entitled to vote before the deadline set in para 1.

Until the assistants and substitutes have been appointed, the applicants have the right to change or withdraw their applications at any time. The regulations under paras 2, 3 and 5 are to be applied accordingly.

Die Beisitzer und Ersatzbeisitzer der vor jeder Wahl neu zu bildenden Bundeswahlbehörde werden von der Bundesregierung berufen.

The assistants and substitutes to form the new federal elections authority, for the purposes of every election, are to be appointed by the federal government.

Die Berufung der Beisitzer und Ersatzbeisitzer in den übrigen neu zu bildenden Wahlbehörden obliegt dem jeweiligen Wahlleiter, und zwar bei den Landeswahlbehörden dem Bundeswahlleiter, bei den Bezirkswahlbehörden dem Landeswahlleiter und bei den Gemeinde- und Sprengelwahlbehörden sowie den besonderen Wahlbehörden dem Bezirkswahlleiter. Tritt hierdurch in der Zusammensetzung der Wahlbehörden gegenüber dem Zeitpunkt der Wahlausschreibung eine Änderung ein, so haben die Vertreter der von der Änderung betroffenen Parteien (§ 14 Abs. 1) innerhalb der von der Wahlbehörde zu bestimmenden Frist die erforderlichen Vorschläge einzubringen.

The appointment of an assistant and substitute in the remaining elections authorities to be newly established is the duty of the respective returning officer. In the case of the provincial elections authorities, this is the duty of the federal returning officer; in that of the district elections authorities, of the provincial returning officer, and in the case of the municipal and ward elections authorities as well as the special elections authorities, this is the duty of the district returning officer. If, as a result of this procedure, there are any changes in the composition of the elections authorities as opposed to the time of the announcement of the elections, the representatives of the parties affected by this change (§ 14, para 1) have to present the necessary proposals before a deadline set for this purpose by the elections authorities.

Die nicht dem richterlichen Beruf entstammenden Beisitzer und Ersatzbeisitzer werden auf Grund der Vorschläge der Parteien unter Anwendung des d’Hondtschen Höchstzahlenverfahrens nach ihrer bei der letzten Wahl des Nationalrates im Bereich der Wahlbehörde, bei Sprengelwahlbehörden im Bereich der Gemeinde festgestellten Stärke berufen. In den Fällen, in denen eine Partei nicht oder nicht rechtzeitig die Berufung der auf sie entfallenden Beisitzer beantragt hat, hat keine Berufung stattzufinden. Für die Bundeswahlbehörde können wahlwerbende Parteien, die im zuletzt gewählten Nationalrat vertreten sind, aber unter Anwendung des d’Hondtschen Höchstzahlenverfahrens keinen Anspruch auf Entsendung eines Beisitzers hätten, jeweils einen Beisitzer nominieren. Die verbleibende Anzahl der Beisitzer ist auf die übrigen wahlwerbenden Parteien unter Anwendung des d’Hondtschen Höchstzahlenverfahrens nach ihrer bei der letzten Wahl des Nationalrates festgestellten Stärke aufzuteilen.

Assistants and substitutes who are not professional judges are appointed on the basis of the proposals of the parties following the d’Hondt procedure depending on the results achieved by them in the last National Council elections in the area of the elections authorities, in the case of ward elections authorities in the area of the municipality. In cases in which a party has not applied, or has not applied in due time, for the appointment of the assistants allocated to it, no assistants are to be appointed. For the federal elections authority, campaigning parties which are represented in the National Council last elected but would not be entitled to delegate an assistant on the basis of the d’Hondt procedure can nominate one assistant each. The remaining number of assistants is to be allocated to the remaining campaigning parties on the basis of the d’Hondt procedure according to their results achieved in the last National Council election.

Hat eine Partei (§ 14 Abs. 1) jedoch gemäß Abs. 3 keinen Anspruch auf Berufung eines Beisitzers, so ist sie, falls sie im zuletzt gewählten Nationalrat durch mindestens drei Mitglieder vertreten ist, berechtigt, in jede Wahlbehörde höchstens zwei Vertreter als ihre Vertrauenspersonen zu entsenden. Das gleiche Recht steht hinsichtlich der Landeswahlbehörden und der Bundeswahlbehörde auch solchen Parteien zu, die im zuletzt gewählten Nationalrat nicht vertreten sind. Die Vertrauenspersonen sind zu den Sitzungen der Wahlbehörde einzuladen. Sie nehmen an den Verhandlungen ohne Stimmrecht teil. Im übrigen finden die Bestimmungen der Abs. 1, 2 und 5 sowie der §§ 6 Abs. 3, 14, 16 Abs. 2, 19 Abs. 1, 2, 3 erster Satz, 4 und 5, 20 und 56 Abs. 1 letzter Satz sinngemäß Anwendung.

When a party (§ 14, para 1) does not have the right, according to para 3, to appoint an assistant and when it has been represented in the last elected National Council by at least three of its members, it has the right to be represented in every elections authority by not more than two persons of confidence. In the case of provincial and federal elections authority, this right is also granted to parties, not represented in the last elected National Council. These representatives have to be invited to the meetings of the elections authorities. They take part in the proceedings, but do not have the right to vote. As for the rest, the regulations set out in para 1, 2, and 5, as well as § 6, para 3, § 14, § 16, para 2, § 19, paras 1, 2, first sentence of para 3, paras 4 and 5, § 20 and § 56 last sentence of para 1 apply accordingly.

The names of the members of the elections authorities are to be published, in conformity with local custom.

Hätten auf die Berufung eines Beisitzers oder eines Ersatzbeisitzers zwei oder mehrere Parteien den gleichen Anspruch, so entscheidet über die Frage, welche Partei einen Beisitzer oder einen Ersatzbeisitzer nominieren darf, das Los, das nach Ladung von Vertrauensleuten der betroffenen Parteien und gegebenenfalls in deren Anwesenheit vom Wahlleiter zu ziehen ist.

Spätestens am einundzwanzigsten Tag nach dem Stichtag haben die von ihrem Vorsitzenden einzuberufenden Wahlbehörden ihre konstituierende Sitzung abzuhalten.

The elections authorities appointed by their chairperson have to hold their constitutional meeting within twenty-one days after the set qualifying date.

In dieser Sitzung haben die Beisitzer und Ersatzbeisitzer vor Antritt ihres Amtes ihre strenge Unparteilichkeit und gewissenhafte Erfüllung ihrer Pflichten gegenüber dem Vorsitzenden durch die Worte „ich gelobe“ oder durch ein Zeichen der Zustimmung zu geloben. Das gleiche Gelöbnis haben auch Beisitzer und Ersatzbeisitzer abzulegen, die nach der konstituierenden Sitzung in die Wahlbehörde berufen werden.

At this meeting the assistants and substitutes, before taking their position, have to give a vow to the chairperson as to their impartiality and conscientious fulfilment of their duties by saying the words "I swear" or by giving a sign of consent. The same vow has to be given by assistants and substitutes appointed to the elections authorities after the constitutional meeting of the elections authorities.

Die Wahlbehörden, ausgenommen die Sprengelwahlbehörden sowie die besonderen Wahlbehörden, sind beschlussfähig, wenn der Vorsitzende oder sein Stellvertreter und wenigstens die Hälfte der gemäß § 15 für die jeweilige Wahlbehörde bestellten Beisitzer anwesend sind. The elections authorities, with the exception of the ward elections authorities and the special elections authorities, are quorate when the chairperson, or his or her deputy, and at least half of the assistants appointed for the respective elections authority according to § 15 are present. The ward elections authorities and the special elections authorities are quorate if the chairperson, or his or her deputy, and at least two assistants are present.

In order for the issued resolutions to be valid, a majority of votes is necessary. The chairperson does not take part in the voting. However, when there is an equality of votes, the vote of the chairperson is the deciding one.

Ein Ersatzbeisitzer wird bei der Beschlussfähigkeit und bei der Abstimmung nur dann berücksichtigt, wenn er für einen Beisitzer tätig wird, der von derselben Partei vorgeschlagen worden ist und an der Ausübung seines Amtes verhindert ist.

A substitute is only included in the constitution of a quorum and the voting if the substitute becomes active for an assistant who has been proposed by the same party and who is prevented from performing his/her office.

Wenn ungeachtet der ordnungsgemäßen Einberufung eine Wahlbehörde, insbesondere am Wahltag, nicht in beschlußfähiger Anzahl zusammentritt oder während der Amtshandlung beschlußunfähig wird und die Dringlichkeit der Amtshandlung einen Aufschub nicht zuläßt, hat der Wahlleiter die Amtshandlung selbständig durchzuführen. In diesem Fall hat er nach Möglichkeit unter Berücksichtigung der Parteienverhältnisse Vertrauensleute heranzuziehen.

When, especially on the election day and irrespective of the regular convocation, an elections authority does not have the necessary number of appointed members in order to be able to constitute a quorum, or when it becomes unable to constitute a quorum during an official proceeding and when the urgency of the official proceeding does not allow for postponement, the procedure has to be carried out independently by the returning officer. In this case, they have the possibility to call on persons of confidence, taking the relations between the parties into consideration.

Übt ein Beisitzer oder Ersatzbeisitzer sein Mandat in der Wahlbehörde aus irgendeinem Grund, ausgenommen die vorübergehende Verhinderung, nicht aus, so hat die Partei, die den Vorschlag auf seine Entsendung erstattet hat, einen neuen Vorschlag für die Besetzung des freigewordenen Mandates zu erstatten.

In case an appointed member or a substitute does not execute their seat in the elections authority, for any reason other than a temporary prevention, the party which appointed them has to present a new proposition for the filling of the vacant seat.

Auch steht es den Organen, die Sprengelwahlleiter, ständige Vertreter oder für den Fall der Verhinderung bestimmte Stellvertreter in den Wahlbehörden bestellen können, sowie den Parteien, die Vorschläge für die Berufung von Beisitzern oder Ersatzbeisitzern erstattet haben, jederzeit frei, die Berufenen aus der Wahlbehörde zurückzuziehen und durch neue ersetzen zu lassen.

The authorities who can appoint election authority returning officers, permanent replacements or in the case of prevention, other replacements, have at any time the right to withdraw the appointed officials from the elections authority and to replace them by new ones. The same right is given to the parties which have brought forward proposals for the appointment of members and substitutes.

Hat eine Partei, auf deren Antrag Beisitzer und Ersatzbeisitzer in eine Wahlbehörde berufen wurden, in einem Landeswahlkreis keinen Landeswahlvorschlag eingebracht (§ 42) oder wurde ihr Landeswahlvorschlag nicht veröffentlicht (§ 49), so verlieren diese Beisitzer und Ersatzbeisitzer in der betreffenden Landeswahlbehörde sowie in allen ihr nachgeordneten Wahlbehörden ihre Mandate, in der Bundeswahlbehörde jedoch nur dann, wenn die Partei in keinem Landeswahlkreis einen Landeswahlvorschlag eingebracht hat oder von ihr in keinem Landeswahlkreis ein Landeswahlvorschlag veröffentlicht wurde. In diesem Fall sind alle Mandate der Beisitzer und der Ersatzbeisitzer nach den Vorschriften des § 15 Abs. 3 auf die wahlwerbenden Parteien, gleichgültig, ob sie bisher in der Wahlbehörde vertreten waren oder nicht, neu aufzuteilen. In gleicher Weise ist vorzugehen, wenn eine im zuletzt gewählten Nationalrat vertretene Partei keine Beisitzer und Ersatzbeisitzer nominiert hat.

When the party on whose proposal assistants and substitutes have been appointed to the elections authority has not submitted a provincial list of candidates in a provincial constituency (§ 42) or when their proposals have not been made public (§ 49) the respective appointed members and their substitutes lose their seats in the province in question as well as in all elections authorities subordinate to it. Under such circumstances they could also lose their seats in the federal elections authority, but only if they have not made a provincial list of candidates in any provincial constituency or when their provincial list of candidates has not been published in any provincial constituency. In this case all seats of the appointed members and their substitutes have to be distributed among all campaigning parties, irrespective of whether they have been represented in the elections authority to date, as set out in § 15, para 3. The same procedure is to be followed if a party represented in the National Council last elected has not nominated assistants and substitutes.

Bei den Änderungen nach den Abs. 1 bis 4 sind die Bestimmungen des § 14 Abs. 1 bis 3, 5 und 6 sowie die §§ 15 und 16 sinngemäß anzuwenden, bei Änderungen nach Abs. 4 jedoch mit der Maßgabe, dass der vorgesehene Fristenlauf mit dem dreißigsten Tag nach dem Wahltag beginnt. Bei Änderungen nach Abs. 4 können innerhalb des vorgesehenen Fristenlaufes auch Parteien die Berufung von Beisitzern oder Ersatzbeisitzern beantragen, die innerhalb der Frist gemäß § 14 Abs. 1 von ihrem Vorschlagsrecht nicht oder nicht vollständig Gebrauch gemacht haben. Ein solches Vorschlagsrecht steht den Parteien auch vor Bundespräsidentenwahlen, Europawahlen, Volksabstimmungen oder Volksbefragungen ab dem Stichtag bis zum zehnten Tag nach dem Stichtag zu.

In the case of amendments according to paras 1 to 4, the regulations set out in § 14, paras 1 to 3, paras 5 and 6 as well those in § 15 and § 16 are to be applied accordingly. In the case of amendments according to para 4 the prescribed time period must start on the thirtieth day after the election day. In the case of amendments according to para 4, parties that have not or have not fully exercised their right to submit a proposal within the period according to § 14, para 1, can also request the appointment of assistants or substitutes within the prescribed time period. Parties also have such a right to submit a proposal before elections of the federal president, elections for the European Parliament, referendums or consultations of the people from the qualifying date until the tenth day after the qualifying date.

Die vor jeder Wahl gebildeten und nach Abs. 1 bis 5 allenfalls geänderten Wahlbehörden bleiben bis zur Konstituierung der Wahlbehörden anlässlich der nächsten Wahl im Amt, es sei denn, die nachträgliche Bildung einer Wahlbehörde gemäß § 14 Abs. 4 ist unabweislich geworden. In einem solchen Fall sind die Vorschläge für die Beisitzer und Ersatzbeisitzer der neu zu bildenden Wahlbehörden spätestens am zehnten Tag nach Eintritt der Gebietsänderung einzubringen. Spätestens am 20. Tag nach diesem Zeitpunkt sind Beisitzer und Ersatzbeisitzer zu berufen. Spätestens am 30. Tag nach diesem Zeitpunkt hat die konstituierende Sitzung der betroffenen Wahlbehörde (§ 16) stattzufinden.

The elections authorities established before each election and changed according to paras 1 to 5, where applicable, remain in office until the elections authorities are constituted for the next election, unless the delayed establishment of an elections authority according to § 14, para 4, has become necessary. In such a case, the proposals for the assistants and the substitutes of the elections authority to be newly established are to be submitted not later than on the tenth day after the area was changed. The assistants and substitutes are to be appointed not later than on the 20th day after that date. The constitutional meeting of the relevant elections authority (§ 16) is to take place not later than on the 30th day after that date.

Für die in vollem Umfang ausgeübte Tätigkeit in den Wahlbehörden am Wahltag sowie am ersten und vierten Tag nach dem Wahltag haben ihre Mitglieder wie folgt Anspruch auf Entschädigungen:

Members of the elections authorities are entitled to compensation for their activities performed to the full extent in the election authorities on the election day as well as on the first and fourth days after the election day as follows:

33 Euro in einer örtlichen Wahlbehörde, in der das Wahllokal bis zu drei Stunden geöffnet ist, sowie für eine Tätigkeit bis zu drei Stunden in einer besonderen Wahlbehörde;

33 euros in a local elections authority in which the polling station is open for up to three hours, and for activities in a special elections authority for up to three hours;

66 Euro in einer örtlichen Wahlbehörde, in der das Wahllokal bis zu sechs Stunden geöffnet ist, sowie für eine Tätigkeit von mehr als drei Stunden bis zu sechs Stunden in einer besonderen Wahlbehörde;

66 euros in a local elections authority in which the polling station is open for up to six hours, and for activities in a special elections authority for more than three hours and up to six hours;

100 Euro in einer örtlichen Wahlbehörde, in der das Wahllokal mehr als sechs Stunden geöffnet ist, sowie für eine Tätigkeit von mehr als sechs Stunden in einer besonderen Wahlbehörde;

100 euros in a local elections authority in which the polling station is open for more than six hours, and for activities in a special elections authority for more than six hours;

50 Euro in Wahlbehörden (ausgenommen örtliche Wahlbehörden), die zur Briefwahl verwendete Wahlkarten im Ausmaß von mehr als zwei Stunden auszuwerten haben.

50 euros in elections authorities (with the exception of local elections authorities) which have to verify, sort and count voting cards used for postal voting for more than two hours.

Die in Abs. 1 festgesetzten Vergütungssätze vermindern oder erhöhen sich, beginnend mit dem 1. Jänner 2025, jährlich in dem Maß, das sich aus der Veränderung des von der Bundesanstalt Statistik Österreich verlautbarten Verbraucherpreisindex 2020 oder des an seine Stelle tretenden Index gegenüber der für Jänner 2024 verlautbarten Indexzahl ergibt, wobei Änderungen der Indexzahlen solange nicht zu berücksichtigen sind, als sie zehn Prozent der für Jänner 2024 verlautbarten Indexzahl oder der in der Folge als Bemessungsgrundlage für eine Änderung des Vergütungssatzes herangezogenen Indexzahl nicht übersteigen. Ändern sich die Vergütungssätze, so sind sie auf einen ganzen Eurocent-Betrag zu runden und im Bundesgesetzblatt kundzumachen.

The compensation rates specified in para 1 will decrease or increase annually, starting from 1 January 2025, to the extent to which the 2020 consumer price index published by Statistics Austria or the index replacing it will have changed in comparison with the index figure published for January 2024; changes of the index figures are not to be taken into account as long as they do not exceed ten percent of the index figure published for January 2024 or the index figure later used as an assessment basis for a change of the compensation rate. If the compensation rates change, they are to be rounded to a whole euro cent amount and published in the Federal Law Gazette.

Von Mitgliedern der Wahlbehörden kann bis drei Monate nach dem Wahltag hinsichtlich des Grundes und der Höhe des Anspruchs bei der jeweils zuständigen Gebietskörperschaft (Abs. 3) ein Feststellungsantrag gestellt werden. § 7 des Allgemeinen Verwaltungsverfahrensgesetzes 1991 – AVG, BGBl. Nr. 51/1991, findet Anwendung. Über Beschwerden gegen Bescheide nach dieser Bestimmung entscheidet das Landesverwaltungsgericht.

Up to three months after the election day, members of the elections authorities can file an application to the competent territorial authority (para 3) to determine the legal ground and amount of their claim. § 7 of the General Administrative Procedure Act 1991, Federal Law Gazette No. 51/1991, applies. The provincial administrative court shall decide on complaints against administrative decisions issued according to this provision.

Das Bundesministerium für europäische und internationale Angelegenheiten kann die Organisation für Sicherheit und Zusammenarbeit in Europa (OSZE) und deren Teilnehmerstaaten zur Entsendung von internationalen Wahlbeobachtern einladen.

The Federal Ministry for European and International Affairs can invite the Organization for Security and Co-operation in Europe (OSCE) and its participating States to delegate international election observer.

Das Bundesministerium für europäische und internationale Angelegenheiten hat gemäß Abs. 1 entsendete Wahlbeobachter sowie die erforderlichen Begleitpersonen zu akkreditieren, diesen akkreditierten Personen eine entsprechende Bescheinigung auszustellen und die Namen der akkreditierten Personen der Bundeswahlbehörde zwecks Weiterreichung der Daten an die nachgeordneten Wahlbehörden in elektronischer Form zu übermitteln. Die Bundeswahlbehörde hat die Daten der akkreditierten Personen grundsätzlich bis zum dreiundzwanzigsten Tag nach dem Stichtag auf elektronischem Weg allen nachgeordneten Wahlbehörden zu übermitteln. Liegen der Bundeswahlbehörde die Daten akkreditierter Personen erst zu einem späteren Zeitpunkt vor oder werden vom Bundesministerium für europäische und internationale Angelegenheiten in der Folge weitere akkreditierte Personen namhaft gemacht, so ist eine Übermittlung dieser Daten auf elektronischem Weg an alle nachgeordneten Wahlbehörden auch nach dem dreiundzwanzigsten Tag nach dem Stichtag zulässig.

The Federal Ministry for European and International Affairs shall accredit election observer delegated according to para 1 and the required accompanying persons, issue the appropriate certificates to these accredited persons and submit the names of the accredited persons to the federal elections authority for the purpose of forwarding the data in electronic form to the subordinate elections authorities. The federal elections authority shall forward the data of the accredited persons by electronic means to all subordinate elections authorities by the twenty-third day after the qualifying date. If the data of accredited persons are available to the federal elections authority only at a later date or if further accredited persons are subsequently named by the Federal Ministry for European and International Affairs, the submission of such data by electronic means to all subordinate elections authorities is permissible even after the twenty-third day.

Begleitpersonen dürfen Wahlbeobachter bei der Ausübung ihrer Befugnisse begleiten; eine selbständige Ausübung dieser Befugnisse steht ihnen nicht zu.

Accompanying persons may accompany election observer during the exercise of their powers; they are not entitled to exercise such powers themselves.

Die Wahlbehörden haben Wahlbeobachter im Rahmen ihrer Möglichkeiten zu unterstützen und für die Beobachtung der Wahl zweckdienliche Auskünfte zu erteilen.

The elections authorities shall support election observer to the extent of their capabilities and provide useful information for the observation of the election.

Wahlbeobachtern und Begleitpersonen ist jede Art der Einflussnahme auf den Wahlvorgang, auf einen Wähler oder auf Entscheidungen einer Wahlbehörde untersagt. Bei Zuwiderhandlung kann der Wahlleiter einen Wahlbeobachter oder eine Begleitperson aus dem Wahllokal weisen.

Election observer and accompanying persons are prohibited from exercising any kind of influence on the election procedure, on a voter or on decisions by an elections authority. In the case of non-compliance, the returning officer can expel an election observer or an accompanying person from the polling station.

Wahlberechtigt sind alle Personen, die die österreichische Staatsbürgerschaft besitzen, am Tag der Wahl das 16. Lebensjahr vollendet haben und vom Wahlrecht nicht ausgeschlossen sind.

All persons who are Austrian citizens are entitled to vote provided they have reached the age of 16 on the day of the election and have not been deprived of their right to vote.
