according to section 1.5.1 of ADR

on the classification of pollutants to the aquatic environment and their solutions and mixtures (such as preparations and wastes), which cannot be assigned to Class 1 to 8 or to the other entries of Class 9

1. (1)Absatz eins,
   By derogation from the provisions of 2.2.9.1.10, last sentence and notwithstanding the provisions of 2.3.5, substances which cannot be assigned to other classes of ADR or to other entries of Class 9, and which are not identified in Council Directive 67/548/EEC of 27 June 1967 on the approximation of laws, regulations and administrative provisions relating to the classification, packaging and labelling of dangerous substances, as amended, as substances to which letter N “Environmentally hazardous" (R50; R50/53; R51/53) has been allocated, are not subject to ADR.

1. (2)Absatz 2,
   By derogation from the provisions of 2.2.9.1.10, last sentence and notwithstanding the provisions of 2.1.3.8, solutions and mixtures (such as preparations and wastes) of substances to which letter N has been allocated in Directive 67/548/EEC, as amended, need only be assigned to UN Nos. 3077 or 3082 if, according to Directive 1999/45/EC of the European Parliament and of the Council of 31 May 1999 concerning the approximation of the laws, regulations and administrative provisions of the Member States relating to the classification, packaging and labelling of dangerous preparations, as amended, they are also allocated letter N “Environmentally hazardous" (R50; R50/53; R51/53) and they cannot be assigned to one of classes 1 to 8 or to any other entry of Class 9.
2. (3)Absatz 3,
   2.2.9.4 does not apply.
3. (4)Absatz 4,
   In addition to the information prescribed, the consignor shall enter in the transport document: “Carriage agreed under the terms of section 1.5.1 of ADR (M148)".
4. (5)Absatz 5,
   This agreement shall be valid until 31 December 2004 for carriage on the territories of the ADR Contracting Parties signatory to this Agreement. If it is revoked before that date by one of the signatories, it shall remain valid until the above mentioned date only for carriage on the territories of those ADR Contracting Parties signatory to this Agreement which have not revoked it.This agreement shall be valid until 31 December 2004 for carriage on the territories of the ADR Contracting Parties signatory to this Agreement. römisch eins f it is revoked before that date by one of the signatories, it shall remain valid until the above mentioned date only for carriage on the territories of those ADR Contracting Parties signatory to this Agreement which have not revoked it.

nach Abschnitt 1.5.1 des ADR

über die Zuordnung wasserverunreinigender Stoffe sowie ihrer Lösungen und Gemische (wie Präparate, Zubereitungen und Abfälle), die nicht den Klassen 1 bis 8 oder anderen Einträgen der Klasse 9 zugeordnet werden können

1. (1)Absatz eins,
   Abweichend von den Vorschriften des Absatzes 2.2.9.1.10, letzter Satz und ungeachtet der Vorschriften des Abschnittes 2.3.5, unterliegen Stoffe, die nicht anderen Klassen des ADR oder anderen Eintragungen der Klasse 9 zugeordnet werden können und die in der Richtlinie 67/548/EWG vom 27. Juni 1967 zur Angleichung der Rechts- und Verwaltungsvorschriften für die Einstufung, Verpackung und Kennzeichnung gefährlicher Stoffe in der jeweils geltenden Fassung nicht als Stoffe identifiziert sind, denen der Buchstabe N „umweltgefährlich“ (R50; R50/53; R51/53) zugeordnet ist, nicht dem ADR.
2. (2)Absatz 2,
   Abweichend von den Vorschriften des Absatzes 2.2.9.1.10, letzter Satz und ungeachtet der Vorschriften des Unterabschnittes 2.1.3.8 müssen Lösungen und Gemische (wie Präparate, Zubereitungen und Abfälle) von Stoffen, denen in der Richtlinie 67/548/EWG in der jeweils geltenden Fassung der Buchstabe N zugeordnet ist, der UN-Nummer 3077 oder 3082 nur zugeordnet werden, wenn diesen nach der Richtlinie 1999/45/EG des Europäischen Parlaments und des Rates vom 31. Mai 1999 zur Angleichung der Rechts- und Verwaltungsvorschriften der Mitgliedstaaten für die Einstufung, Verpackung und Kennzeichnung gefährlicher Zubereitungen in der jeweils geltenden Fassung ebenfalls der Buchstabe N „umweltgefährlich“ (R50; R50/53; R51/53) zugeordnet ist und sie nicht den Klassen 1 bis 8 oder einer anderen Eintragung der Klasse 9 zugeordnet werden können.
3. (3)Absatz 3,
   Unterabschnitt 2.2.9.4 findet keine Anwendung.
4. (4)Absatz 4,
   Zusätzlich zu den vorgeschriebenen Angaben hat der Absender im Beförderungspapier zu vermerken: „Beförderung vereinbart nach Abschnitt 1.5.1 des ADR (M148)“.
5. (5)Absatz 5,
   Diese Vereinbarung gilt bis zum 31. Dezember 2004 für Beförderungen in den Hoheitsgebieten der ADR-Vertragsstaaten, die diese Vereinbarung unterzeichnet haben. Wird sie vorher von einem der Unterzeichner widerrufen, gilt sie in diesem Fall bis zum vorgenannten Zeitpunkt nur noch für Beförderungen in den Hoheitsgebieten der ADR-Vertragsstaaten, die diese Vereinbarung unterzeichnet und nicht widerrufen haben.

Die Vereinbarung wurde von Österreich am 9. Jänner 2004 unterzeichnet.

Weiters haben weitere nachstehende ADR-Vertragsparteien diese Vereinbarung unterzeichnet:
